David M. Hirschberg focuses on advising clients on issues relating to information privacy and data security. He has particular experience in assisting corporate clients in implementing comprehensive information security programs which protect data from both physical and electronic threats and for ensuring compliance with federal, state and local regulation. Mr. Hirschberg has also helped clients respond to breaches in the security of their systems, and has advised clients on how to avoid the dangers posed by identity thieves.
Mr. Hirschberg also counsels clients in the area of electronic discovery and data management and has developed document retention and secure destruction policies for clients which comport with applicable regulations and emerging best practices. Mr. Hirschberg’s experience with the domestic and international aspects of data collection and management, including matters relating to the importing and exporting of data from Europe and Asia, provide him with unique insight into the relationship between domestic and international data flows.
In addition, Mr. Hirschberg has been involved with a broad array of issues relating to the operation of businesses on the internet. He has drafted privacy policies, user agreements, service agreements and intellectual property licenses. He is particularly well-versed in advising clients on the issues raised by user-generated content incorporated into web sites as well as the application of copyright and trademark to new and emerging technologies.
Prior to pursuing a career in law, Mr. Hirschberg worked in the financial services and educational fields. While pursuing his undergraduate degree in physics, he was a laboratory assistant in the Cardio- Biophysics Laboratory at the Washington University in St. Louis School of Medicine.
Mr. Hirschberg has also served as an instructor for Emanuel Bar Review and the Head Attorney Instructor in New York for Lawtutors, LLC.
